What can I do if I was hired under fraudulent circumstances?
I was contacted by a company to work as the Workers' Compensation Coordinator for a PEO Company.
At the time, I was earning 40,000, mileage reim (approx 400 mo.), 6 yrs employment, 3 wks vac pay, med benfits and 10 min from office.
The new company offered 50,000 w/ a 400 car allow. However, I was concerned about the job security and request their ability to obtain W.Comp Ins (PEO's are a high risk). I was informed they already had a policy and was given the policy no.
Now after 30 days employ. I was laid off for 2 to 4 wks (most likely longer) because they had not been able to bring on the clients. One of the reasons was the w. comp policy I was given was not actually issued because they did not submit the Pmt. Now the rates have increased. I was also not iaaued my car allow. from prev. mo. Nor was I pd for the 9 days in the current mo. I have e-mailed the request, but they have not responded. What legal action is avail?
When I met with them, they asked what it would take for me to work for them. I explained thaover five years with the company I was with, I had 3 weeks vacation pay, I had been employed over five years

You can pursue your claim for unreimbursed expenses and owed wages through the Labor Board. You can also seek penalites of up to 30 days wages and interest.

Fraud in hiring gives you the grounds for a civil suit. If they recruited you away from your steady employment with those false promises, the case value would be more than just your lost incomey, and would include general damages, possibly punitive damages.
