Legal Question in Employment Law in California

Can't get hired after termination

I'm a truck driver who had an

accident that during an ice storm in

KY, and at the time was cited for

''fleeing the scene of the accident'' by

the officer. I contended that

the accident was unavoidable and the

other truck driver's fault. Two days

later, I was required to report to a

company terminal where I was

terminated by a manager I had never

met and who could not provide a

specifics for termination other than

by way of reference to 2 accidents on

his computer screen. So, this one

no-damage no-fault event, and the

other is a claim by

another driver for an unsubstantiated

event from months ago. I have not

been provided any documentation of

that claim, and insist no accident

occurred. I tried to contact

my employer later and piece together

my problems, but nobody would

return calls. I was able to

collect unemployment however.

After months the citation was

dismissed. There is nothing on my

DAC report, but I can't seem to get

another job.

Re: Can't get hired after termination

Why are you asking CA attorneys about a KY incident and charges? If you were a KY employee, we can't help you. If you were a CA employee, we still can't help you with KY problems, and you were an 'at will' employee for CA unless under union or written employment contract that would determine your rights. At will means you get fired whenever they want. Getting a new job is up to a new employer, who will be checking your driving and accident records. Truck drivers with accidents and tickets and convictions probably won't get hired, and records are forever. If the KY record is somehow incorrect, then seek a KY attorney to see if it can be corrected.
