Legal Question in Employment Law in California
Hi there,
I hope you can help me. Appreciated in advance for reading!
I got yesterday letter from employer that my position will be eliminated in next 6 months. In other words I got layoff. Unfortunately this is second time that company gave me the layoff. Exactly one year ago my contract was terminated, however after two weeks of announcement I found a new job and communicated to my manager that Im leaving in 2 weeks. Mangers quickly organized new position in US and offered me relocation from EU to US. I decided take this opportunity and I was rejected offer from new company. Eight months ago I moved to US and Im working for this same company, however yesterday the Company decided to lay off 100 people including myself. Im really upset that Im facing layoff again and I did so much to move to US and now I need back and start life again. In my view the company should not treat me and my family (2 small kids) in that way and Im looking some legal advice how I can resolve this dispute with employer. My email [email protected] .
Thanks

Resolve it?? Unhappily, your have little to no recourse as an 'at will' employee in CA. The company's business and financial troubles easily justify your layoff, unless you have a contract to the contrary. Try to negotiate a severance package, using whatever sympathies you can muster.
