Legal Question in Employment Law in California
My husband is in the Construction field and we reside in the State of CA. My husband was recently told by his Employer that he would be paid mileage for coming back from a job, however he would not be paid his hourly wage. This gave us pause since most of my husband's jobs are anywhere from an hour to two and a half hours away. He was told that he would be paid if he was going from one job to another, however not if he were traveling home. My husband averages 20 hours a week in overtime and is basically on call 24/7, and based on our location he is out and about during inclement weather where travel time can sometimes take up to 5-6 hours depending upon road conditions. We understand that all to most employed workers do not get paid an hourly wage once they leave the building, however since my husband's job does involve significant travel, we were wanting to make sure that his employer is following the CA Labor Laws.
