Legal Question in Employment Law in California
My husband was suspended from his job on 10/31/2011 stating that he went below his percentage requirements for work (he gave a 92.7 one 10/25/2011) He was not given anything in writing to state how long he was suspended nor was he told how long he was being suspended, they sent him home and told him he would get a call when he could come back to work, on the 3rd day he went in to work and was told that he would be contacted by HR when to come back to work, his union rep told him that if he was not called in the following day to come in, he went in and was again told that he would be contacted by HR when to come in, The manager told him the HR lady had to review his percentage and wouldnt be in until monday. He has got no answers as to when he will be allowed to return to work, He asked if he was being terminated and they told him they did not know until it was investigated. I want to know is there anything he can do in regards to this matter. He is a teamsters union member but they seem to be giving no help in the matter.

You should have led off with the fact he is in a union, and not wasted everyone's time reading your facts. That union and its grievance process is his ONLY remedy, whether you like their responsiveness or not. He gave up his 'employee rights under state laws' when he joined the union and paid all those dues for their 'protection'.
