Legal Question in Employment Law in California

hi iam a full time employee at an insurance agency... at least i think iam. i work 34 hrs a week and i have been at this job for a yr doing more and more work yet i still get paid 9 dollars an hr..but tha tis not my question, i just recently am able to get medical benifits but our grace period for a full time employee is three months, though i get benifits my boss says iam part time when it comes down to my PTO. does this makes since??? i work for my husbands aunt and i feel like she is fully taking advantage of my work. how many hours is considered full time and C.A????

Full time or part time is not the issue. Your company policies determine what, if any, benefits you are entitled to. If you are defined as full time, as you stated, then you are entitled to the same benefits as all other full time employees in your classification. CA normally deems 32 + hours as full time, unless otherwise defined by the employer. If part time, then you are entitled to the same benefits as all other similar part time employees. Yes, insurance can have limited sign up periods that end, and are typically open at least once a year. Ask to see the company policy and insurance company handbook of the subject of signup.
