Legal Question in Employment Law in California

illness

I need advice, I'm on temporary leave from my job due to illness.Is it right for my employee to harass me over the phone day after day?, then they had the nerve to call my medical group.The(the medical group) gave them all my information without my consent. Now they are calling my doctor and harassing his office concerning me. As I prepare for emergency surgery waiting on insurance to approve in pain.Been 4 weeks already.Doctor will not release me until surgery and healing. I feel my rights are being violated. Knowing the company I work for seen me trying to come to work in pain and vicodin before I were place on leave.All I feel they are concern about is not being short handed for their convention that's coming up. My health doesn't matter because they are calling and saiding such mean things to me everyday.Surgery is hard enough,I dont need extra stress.

You have a right to medical leave, and right of privacy with your doctors. The doctor shouldn't have released any information without your written consent, and the company shouldn't have asked without it. The company is entitled to confirmation of your condition, but not to see all your records. You should have an attorney 'educate' them about your rights, and make sure they follow the rules about your leave. Contact me if interested in doing so.
