Injured at work and employer not insured

My friend needs a lawyer- he injured his back at work, and then found out his employer (a towing company in Barstow)didn't have insurance. Do we look for a Workers Comp attorney, or is it now a civil case and look for a personal injury attorney?

If employer does not have an insurance..emplyoee still can proceed with WC case and make a claim from State's Uninsured Employer's fund..where state pays then tries to collect from the employer. But in my opininon it is better to go through PI route.
