Legal Question in Employment Law in California

My job just got a new manager and she has cut my hours. I am one of only two white employees and the other white girl has been there the longest so her position can not be changed. The manager we recently got is hispanic as well as all other employees. When we lost one of our full-time employees recently, I inquired about the full-time position. She said that she wanted to change the position and have the person work overnight 3 nights a week and one night would be alone, so she preferred a male for the position. That is understandable, however she hired a new guy and he is working 2-10 4 days a week and no night shifts. On top of that, she just cut my hours again, having me work only 6 hour shifts instead of 8 which I have never seen at this place before, but she is giving one of the hispanic girls overtime every week which is unneccessary considering I am available. I was wondering if I would have a case for discrimination and be able to sue?

If she is cutting your hours while working another employee overtime, that sounds like the starting point for a discrimination action. More information would be needed to be sure there is no defense, but this sounds worth talking to an attorney about.

If you have any evidence, other than your speculation and the circumstantial 'smell', that this adverse treatment is 'because of' racial/ethnic discrimination, then you would have grounds for legal action.
