can the judgment be amended to include the thief?
I'm in California and I have received a judgment against my former employer for unpaid wages. The award was against only the company. On several occassions, I received pay from the COO's personal checking account since he was solely responsible for paying wages, therefore it can be proven that I worked for him and that he is the agent and company representative.
He was given money for payroll expenses and instead he used them for his personal well being, closed the company, ignored wage claims and mail from the Department of Fair Employment and Housing, failed to pay wages and penalties awarded to me by the Labor Commissioner and has caused undue financial hardship, while he lives in the richest city in luxury in the State of California.
I NEED AN ATTORNEY that knows what I'm talking about and willing to assist me in obtaining the money he stole from me.

If you have written proof of payment from an officer's accounts, you have a very strong case for assertion of individualized liability under the Labor Code. Your attorney can seek an amendment of the judgment to add the individual, or seek to bring him into the action. Either way, you will have to prove the personal liability of the man for the company debts. After success at that, you would attempt collection.
