Legal Question in Employment Law in California

''Laid off'', what are my rights

I worked as the Library Director at a small college.

I was laid off, and told my position was being

eliminated. The library staff consisted of myself, and

an assistant librarian. There are areas for

consideration with accreditation here; the school

recently went through an accreditation (regional). They

reported me in the position in the library (as well as

another full time position they let go). They kept my

position, until they submitted the report, then let it go.

As well there are other problems with the accreditation

report; I want to report this to the accrediting body but

would like to know about legal protection before I do it.

Also I'd like to know what are my rights regarding being

'laid off' (I felt this was more of a firing) and with being

told my position is eliminated.

Do they have the right to bump the assistant into my

position, or to advertise for the position?

Report them if you want, what can they do, fire you? The termination may be 'wrongful' but there are limits on what it is worth without illegal conduct. We may be able to obtain a reasonable severance package for you, based upon those facts. Call if you want to discuss 714-960-7584
