Legal Question in Employment Law in California
laid off because of unfair/discrimination
I worked for a company about 1000 employees. There were 16 out of 45 employees in this department were laid off. Among these 16 employees, 10 out of 10 Chinese employees in this department were laid off. Is it considered a unfair/discrimination laid off to Chinese?

Very likely...we can show discrimination in this case. Do you have any other pre-termination fact to support this? Previous termination decision, racial slurs, etc.

If you can demonstrate that the layoff of these people was 'based upon' them being Chinese, at least in part, then you may have a claim of discrimination. Contact me to discuss the facts available if you want to pursue this.
