I have a gardener coming by to remove a tree and want to know how to cover myself in case he injures himself on my property

When you hire an unlicensed contractor, you are in effect hiring an employee with all of the legal obligations and duties. It is critical at the least that you confirm that you have workers' compensation insurance coverage under your homeowner''s policy or a separate policy to cover such workers. Talk to your tax adviser to determine what, if any reporting requirements you may have for sums paid the contractor.

It would be beneficial to review your homeowners insurance policy and/or have an qualified agent do so for you. You may also contact the homeowner insurance provider directly and ask your specific question. Another piece of advice... ask your gardener to provide proof of their own insurance.
