Legal Question in Employment Law in California
liability for relocation expense/bonus
In october of last year a health care facility, relocted me, and extended a sign on bonus for my employment. The term of the contract is two years. My situation is this (1) the facility misrepresented the job IE: the shift I would be working/and work conditions. My fault with this, is I did not require the facility to put in writing the exact shift /hours I would be required to work.
There is a stipulation in the contract for my terminating my employment before the 24 month period is over and states that I would be required to pay back the bonus/relocation assistance at a pro-rated amount. My question is this; Are there any grounds that I can argue the repayment of funds that have been extended to me ie: relocation expense and $5,000 of a $10,000 sign on bonus?
Thanking you in advance for your help.

Re: liability for relocation expense/bonus
Things like this can be negotiable, given your allegations of misrepresentation. If you want to quit, don't do so until you discuss the options and possibility of getting the terms changed. Contact me if interested in doing so.
