Legal Question in Employment Law in California
I live in Los Angeles, California. I work as a merchandiser for a retail chain. I work in a different store every 3 weeks. I do not have a permanent home work location. TMy work location on my pay checks says "use employee home address". I travel alot for work and have frequent stays overnights in a hotel. I work 4 - 12hour nights and have 3 days off. My employer pays travel time but not for the first hour. So I have to leave 1 hour before my scheduled start time. For Example I live in LA and work in bakersfield right now. It takes me 2 hours to get to bakersfield. Our official start time is 5am. I am expected to leave my house at 4am and drive without being payed until 5am which is our official start time. Is this legal ? I ended up working more than 12 hours because the 1st hour is drive time that I am not paid for.

IT is your choice where you live, how close to work. The company is probably complying with the law per your description. If you disagree, you can always try to file a wage claim with the Labor Commissioner, who will review the facts before accepting the claim.
