Legal Question in Employment Law in California

LL Question

If organizational changes occur in a company which could force steller performers in a position lower than the position in prior to changes, is it fair? Is there any law hat would prohibit such a change. I am the only person who was told my title and status have to change. Others who contributed to the change have not been asked to change thier title or be subject ti a demotion.

Re: LL Question

Unfortunately, the law does not legistate employer's treating an employee with disrespect. However, should the actions you describe be taken based on discriminatory animus or in retaliation for a complaint, then the actions are illegal. For example, if you are the only female, only person over 40 years old, only person who is a Muslim, or only person of a different race/national origion, with a disability, because you blew the whistle on illegal conduct, or complained of sexual harassment, while your peers did not or are not, then the actions you described may not be poor business but actually discriminatory or in retaliation. If so, then you may have to look into your options of what to do next, complain, to whom, in writing, look at your employee handbook for assistance and more.

If you feel that you are being the victim of one of the above, or something to that affect, you are welcome to contact any attorney in your area or our office. Best of luck.

Sincerely, Beth Mora
