Legal Question in Employment Law in California
Medical Employment Registry Pay
Is there a cap on the amount an employment agency can make from an employee? (I just found out what my employer charges the facility I work at). The facility they send me to is charged $480/8 hour shift. I am paid $27/hour (1099 is used so no taxes are taken out)or $216/8 hour shift. An additional 25% is charged for weekend shifts, and an additional 25% is charged for graveyard shift. I work Saturday graveyard shift so the facility is charged $720 for the shift I work. That's $520 dollars profit they make when I work! I should receive a portion of the 25% for graveyard and weekend shift but I don't. Am I simply being taken advantage of or does the agency have any legal obligation to pay a certain percentage or... Is this a legal issue at all? Please advise.

As long as you are being paid the agreed hourly and appropriate OT, you have no gripe that they make money by providing you a job. Next time, try to negotiate the rate you are paid.
