Medical Insurance FMLA & WC

Help! We are 100 + employees Nonprofit, Childcare contracted with city and state for funding. We have several ee's out on workers comp and at the same time they were placed on FMLA. Our Policy for conintuation of Health Care Benefits (ee's on Disability/Medical leave is for 4 months and we will maintain group health insurance doverafe for the calendar month following the month in which the leave begain on the same terms as if the employee continued to work. When pd coverage ends for the ee on leave the employee ee may continue group health ins. with us in conjuection with COBRA guidelines for the amount of the relevant premium. We pay 100% coverage for the individual and ee pays for any dependent coverage. When the ee goes on

leave longer than our policy we give ee the option of continuation on COBRA until they return to active duty.

I am hearing that this may be discriminato ry ? HELP
