Megan's Law Abuse

Can someone be terminated from their job (which they have been employed for 5 years), because the employer found out that the employee is listed on the Megan's Law website and the offense happened almost 16 years ago. He is not a violent preditor.

There is no easy answer; it would depend upon the nature of the employer, job duties, insurance requirements, state and federal regulations, etc. For instance, such person can NOT be employed in education or child care, and can be denied various professional licenses. However, there is provision in the law that makes it improper to discriminate against someone in employment solely because of criminal record, unless other provisions overrule it. Another aspect of this is the possibility of perjury on the original job application if the felony conviction was falsely denied. If that occurred and they find it, firing is justified at any time therafter. With all that, if you still think the firing is unsupportable, contact me to discuss potential remedy.
