overtime pay with nanny

hi, had a child care provider that worked for us in our home for 18 months. She never worked more than 40 hours/week and I only work 4-6 days per month, so it was limited. She did not spend the night. she's claiming we owe her overtime pay. Isn't that exempt with child/home situation? Thanks in advance

Whether she is or not, you now have to defend the claim, which she can bring formally through the Labor Commissioner, seeking wages, interest and penalties for any payment violations.
