Legal Question in Employment Law in California
Payment
I am a private contractor doing work for only one small company. I inspect homes for insurance compliance and after completing the inspection, I would write a report and received payment twice a month for all the inspections I had completed. I became ill last fall and was in extreme pain and frankly a little distracted. My boss contended he paid me for September's jobs, but I have no record of having received that check. He has showed me a photocopy of the check but refuses to give me a copy so that I can track it through my bank. My bank has contacted him and he refused to give them any information, he has contended to me that he has put his records in storage and I have had my bank search for the amount of the check and they have not come up with anything around that amont. Now what? How do I get a look at the back of that check so my bank can research it? Either I did receive the check and the bank posted it to someone else's account or I didn't and the reason he is being so uncooperative is that the check was not issued and he just showed me a copy of the back of one of the other checks I received from him.

Re: Payment
Under $ 7.5K? Have him prove it in small claims court.
Re: Payment
Tell him you will be forced to file suit if he doesn't provide access to the front/back of the check as adequate proof you cashed it. File in small claims for money due if it comes to that.
