Legal Question in Employment Law in California

pension payments

My friends husband just died of cancer. He was a member of the sheet metal workers Union. He never filled out the papers designating his wife as the beneficiary of his pension in his death. He died rather quickly and wasn't a very resposible guy in that way. He started to fill out the papers but didn't finish. He also had no will.

Can she still collect his pesion maybe due to special circumstances? Is there anything she can do? She has very little to live on, and a wreck of a house to live in?

He daughter and grandson live with her? She really need to know what her options are and she scared because she has no money and no real income. He was receiving disability payments when he died. Where can we start? She lives east of Redding, CA. Very small town. Help please.

contact a local attorney to help with the probate, which will be the vehicle for making a claim on the benefits. If she was his only wife, she will be entitled to them unless he had named someone else earlier. It could get messy, and she needs expert help.
