Legal Question in Employment Law in California
What can a previous employer say
I had worked at a company for almost 6 years. During that time I had received raises, been promoted to manage 2 employees. I had never, never had an evaluation during all my years there. Then I had turned the manager into human resources for harrassment. He had held a grudge ever since then. I work for a long time after that. Then one day I had an asthma attack. Was taken to the hospital. This was the first only one I had ever had. The next day I went to work. I was called into the office and told I was being laid off. I was not given a reason nor paperwork. I asked for paperwork about 2 weeks later and never received it. I had received 3 job offers from other companies since being laid off. All 3 companies then called this one company to verify previous employment. All of a suffen, they didn't need me. Or the position became filled. Just how much can a previous employer say about a past employee?

Re: What can a previous employer say
IF the "turning in the manager" occured several years ago, it would be hard to prove 'retaliation' now.
Bad mouthing you is a different issue. Have someone call on pretext of checking your references, and see what the company actually says about you. Make sure to get the name of the person making the statements. Then feel free to contact me if interested in discussing your rights and remedies.

It sounds to me that you may have a claim for wrongful termination and/or retaliation if you were terminated less than a year ago. Please check out my website at http://www.tgm-law.com and contact me if I can be of assistance.
