I was recently "laid off"....and later found out I was the only employee let go due to company downturn?...Was told i was part of a mass layoff in the company? Days later I replied to a Add

the company had posted to fill the position??......I was told the Position was terminated entirely

and would not be refilled?.....and actually was considered for "rehire" being that they didnt know who was replying to the add??......Is this discrimination??...I was let go NOT due to company hardships?

and Have documentation of all this??......can you help?

Hello.

It is possible that the company is trying to cover up the true reason for your "lay-off" or termination. However, it is not clear from the facts your provide what might be the true reason for your termination. Normally, this kind of patterns happens when the employer is discrimination against a certain employee based on age and is trying to get rid of older employees by laying them off, so to speak. In general, unless you are in a union or have a written employment contract, you are an 'at will' employee that can be disciplined, laid off, or fired any time for any reason, other than illegal discrimination under the Civil Rights, or Whistle-blower, or similar statutes. You said nothing to so indicate. Your goal should be to keep your employer happy with you.
