Legal Question in Employment Law in California
So I requested on a personal action form to use vaction time but my employer used my sick time with out asking, is this illegal?

It is in your favor, so why are you worried about it? First, if you run out of sick time you can use vacation time, but if you run out of vacation time you cannot use sick time unless you want to get fired for lying about being sick. Second, if you have unused vacation time when you leave this employer for any reason, they have to pay you for it. Unused sick time just goes away.
