Legal Question in Employment Law in California
Set up for Failure
I work for a County Agency, I was served papers for a Skelly Hearing that contained several outstanding accusations. I proved my case and won the Skelly, however instead of me being placed back in my old position I was sent to work 50 miles away from my home under new supervision and a new position. Don't get me wrong I'm thrilled to have won, but I am afraid I have been set up for failure. Also during the process of the Skelly Hearing I was given information that my supervisor had called an old employee and informed her to apply because I had been fired. Not true, because I was on Admin paid leave. Bottom line, I hate my new position, I don't like the atmosphere, I don't like that I'm now driving 100 miles a day when before I was driving 5 and I don't like what this agency has put me through.
WHAT CAN I DO????

Re: Set up for Failure
If you are a county employee, chances are you belong to a union. I would talk to the a union representative first about your options. They might be willing to file a grievance on your behalf.
If the union is not helpful, you can consult a local employment law attorney.

I am unable to assist you in this matter as Skelly Hearings are outside of my practice area. I suggest you contact Janis E. Eggleston in Berkeley, California at [email protected].

Talk to your union rep. If you don't belong to a union contact a local employment law attorney.
