Legal Question in Employment Law in California

Severance upon termination

I am fairly certain I am about to be terminated from a senior management position at my company. I have not been at the company long enough to pursue a wrongful termination suit. How could the services of an experienced attorney help me to best negotiate my severance package , i.e., appropriate letters, strategy advice, etc? Of course I am willing to pay for the assistance I am seeking.

Before you can be told what an attorney can do for you, he needs all the facts. Call to discuss. 800-685-6950

An attorney may be able to do all those things. The sooner you get one involved, the more likely he can keep the termination from even been disclosed. This is a specialty area I have practiced for over 15 years. Contact me if interested.

Re: Severance upon termination

I agree there are not enough facts to really answer your question, but let me at least address some considerations. You should not assume that your anticipated firing cannot be wrongful just because you are short-service. If you are fired for age, race, religious beliefs, disability, gender, pregnancy status, reaching retirement benefit eligibility, whistleblowing and a whole host of other things, you could still have a claim. You have to look for potential claims to leverage in the negotiations. You also have to emphasize your demonstrated value and contributions to the company, their potential interest in your not having to run to a competitor immediately, how it looks bad for the company if their senior management people are suddenly put on the street, and request information on any written severance plans the company may already have.

Feel free to e-mail me at [email protected] if you would like to discuss it further.

Although I now practice in Georgia, I am also a member of the California Bar, so your question was referred to me.
