Legal Question in Employment Law in California

Sexual Harassment

I want to file a sexual harassment complaint against the owner/president of my company but I am in the middle of getting my permanent residencey here in the US. The company filed an employment based petition for me. Because of my current immigration status I feel trapped. Leaving the company would mean losing my permanent residency petition.

Can I file a complaint anonymously?

Re: Sexual Harassment

You can't file anonymously. however, you have a right to file a lawsuit for sexual harassment regardless of your immigration status. If you get fired then this action is considered to be retaliatory and you may have a valid case of wrongful termination. Call us at 213.388.7070 if you need representation.

No, you can not file anonymously. retaliation such as termination over your filing would add a cause of action for wrongful termination. Contact me directly.

Re: Sexual Harassment

No, you can not file anonymously. Your complaint goes straight to the company. You are, however, legally protected against retaliation over your filing. IF you have a valid case, with evidence to support your claim, then do not hesitate to file 'on principle'. You should consult with experienced counsel for an opinion on your case before taking any action. Feel free to contact me if serious about doing so, and serious about pursuing this.
