Can an illegal alien sue me for wages that I already have paid?

Undocumented workers are entitled to pay for the work they have performed, regardless of their immigration status.
As to whether the worker can sue, the answer is "yes," anyone can sue. Whether the worker will win is another story. Make sure you have all of your evidence of payment in order.

Being illegal has nothing to do with it. If you don't have evidence of wage payment, he can claim he is unpaid. Cash payments under the table have risks.
