Legal Question in Employment Law in California
I was terminated a year ago for job performance. I have applied for several jobs and have good interviews but not called back. I look at my termination paperwork and it says I was fired for misconduct which isn't true. I think when a background check is being done this comes up what can I do to get it out of there it was not misconduct.

Contact the past employer and try to correct the records, or get an attorney to do so. If they won't do so, and if you can prove they are making 'false' statements about you, that could be grounds for a lawsuit.
