Legal Question in Employment Law in California
termination based on felony
I have a question I have been working for a company for the past 8 months now and my supervisor knows that I have a felony but HR does not. If they terminate me do I have grounds for unlawful termination. I have never been provided a handbook with any of the company policies or rules. I was working for another company and I was grandfathered in too this company.

Re: termination based on felony
companies are not supposed to discriminate on convictions, but you would have to prove that is their motive if they lay you off. If it happens, and if you think you can prove that reason, then feel free to contact me to discuss. In the meantime, you could consider expunging the conviction from your record if possible. Contact me if seriously interested in doing so.
Re: termination based on felony
It depends on the circumstances involved. I suggest contacting me to discuss this further. I will need to know what their company policy is on felonies and/or termination grounds thereto. Thanks.
