Legal Question in Employment Law in California

Termination after Resignation

I work for a corporation in Los Angeles, CA. Can an employer terminate an employee after a resignation has been submitted with the proper two week notice? Also, will the employer have to honor the resignation in terms of paying for the two weeks salary, or can they not honor the notice and not pay for that time period and terminate the employee? My employment is at will. The only reason why I am giving two weeks is so that I am employed as of a certain date for my commissions, and for a referral bonus that would also be due around that same time. Thanks for any guidance on this issue.

Re: Termination after Resignation

The employer may terminate you at any time, except for unlawful reasons. It is not required to keep you employed during your two-week notice period. That said, the commissions and bonus issues would have to be reviewed separately, and more information provided.

You resign, they walk you out, that is the norm, and smart policy. IF under company rules you are entitled to payment of an 'earned' bonus even after termination, then you are lucky, most companies don't have such policies.
