Legal Question in Employment Law in California

theft of credit card

When I was at work somebody stole one of my credit cards and used it. I found out where the card was used at and I know exactly who the thief is.I have filed a police report and credit card company is involved, in the meantime I have to work near the thief until he is arrested. This person in the past has been a gangbanger and still does graffiti, so I am concerned that this person could be a danger to me. I have been at this company for 10 years, they don't seemed to concerned unless he steal something from the store. How can I know for sure who I am dealing with and feel safe at work?

Re: theft of credit card

It appears you have already advised your employer. However, you should provided a copy of the police report and evidence of the stolen credit card to your employer. Advise your concerned for your saftey and request in writing that you want to work in a different location than the other employee, and/or you want the employee terminated.

Eventually, you may need to seek legal counsel as you may have a tort if the employee does cause you harm. However, you have to wait and hope nothing happens.

Best of luck to you,

Beth Mora
