Legal Question in Employment Law in California

Threatened at work

I was threatened at work today by a guy I work with (I'm a woman). I gave a complaint to my manager and she told me it was possible that I would be suspended (without pay) as well as him. Is that legal?

Re: Threatened at work

If the only thing that happened was that you, minding your own business, were approached and threatened with violence, then no, I do not believe it would be legal to take employment action against you.

This very much depends, however, on the details of the incident:

>> What kind of threat, exactly?

>> What exactly did he say or do?

>> What exactly did you say or do in response?

>> What words/actions were exchanged leading up to the threat?

If he also accused you of something, then the company can put both on leave and investigate. It would have to be a credible accusation to justify that. Your real concern is discipline or termination. If that happens to you, and you think you can show you were a victim, not him, contact me to discuss.
