unfair labor practice
is there any legal recourse for employee or group of employees who have company attendance policy appllied inconsistently - and that may result in termination of one employee and not another for same or more severe issue

In a union, yes. If it is discrimination based on protected category [race, age, sex, etc.], yes. Otherwise it is poor management, not illegal. You should pursue HR complaints and request for remedy.
