Legal Question in Employment Law in California

my union failed to file my grievance in the required time frame so it was rejected. What recourse do i HAVE. can i sue my union in small claims court because they failed to diligently represent me and request that my union dues be paid back to me

None and no, to all the above. IF they utterly failed to do ANYTHING, absolutely nothing, then you theoretically could sue the union and the company in United States District Court under the federal runes. That would be expensive and very unlikely to succeed, even in the best of cases, which are rare indeed. Welcome to union employment.
