Legal Question in Employment Law in California

vacation time

I have 21 days a year of vacation plus sick days. I will be going on maternity leave in late september, my boss has taken five days away from my vacation. He said because I will not be there the whole year. I thought maternity leave and vacation days were separate? Can he legally do this?

Re: vacation time

A company can require you to use accrued leaves against your FMLA pregnancy leave. You're entitled to FMLA pregnancy leave if you've been there at least a year. If you think they are violating the law, feel free to contact me to discuss the facts.
