Legal Question in Employment Law in California

If you work for a company and the company is in a law suit and a employee name is listed as a defendant in the paperwork for the law suit and the employee has never been notified of this by his company, is this considered Negligence??

If the lawsuit is work-related, the company should be providing the employee with a defense. The employee should speak with those dealing with the lawsuit to make sure that a defense is being provided. Otherwise, the employee should retain a personal attorney who will then demand that the employer pay for the legal fees and expenses.

No. If you had been served with the lawsuit and forced to defend it, then the company should provide taat defense. If they are already doing so, be happy you don't have to pay for an attorney. You should talk to the company to understand what is going on.
