Legal Question in Employment Law in California

I work for a hotel chain, and they have been deducting an hours pay from their employees that don't take a half hour lunch break within 5 hours after they have started work. They do this even if a lunch break is taken if its been more then 5 hours since starting their shift. They call it a meal penalty on our pay stubs. Is this legal to deduct an hours pay for a half hour lunch break?
