Legal Question in Employment Law in California

I worked for a Dentist who refused to pay me overtime. How long after terminating my employment do I have to sue him for back pay? What are the chances that I will be compensated and will I have to pay alot of attorney fees? Will I have to goto court or can I have an attorney send him a letter and force him to pay me? If I need an attorney can you refer one to me. Thank you. Jean Bishop

You might file a complaint with EDD, the California Labor Commissioner. You would have to provide a calendar with the hours and days you worked overtime and were not compensated, if you don't have copies of your time cards. There are waiting time penalties for unpaid wages. That won't cost you anything.

Your claim can 'look back' for three years of income. The sooner you file, the less you lose from being time barred.
