Legal Question in Employment Law in California
I worked for a restaurant in San Mateo County, CA. almost two and half years and did not get all of my hourly wages. Most months they did not pay me at all and some months they paid me with minimum wage ($8/hour). I quit that job 14 months ago and still did not get paid. I have two employment verification letters signed on two different dates by my previous employer that says I have been working for that restaurant since that day and get paid $15 an hour. They paid me only partially and they still owe me most of my worked time.
Do I still have a case, if I do should I file at San Mateo County, CA.

You can go back as far as 3 years for unpaid wages. You will need to assemble all documentation you have to prove you worked the hours and dates you claim and were not paid the wages earned. File your claim with the nearest Labor Commissioner's office. They have forms for you to fill out indicating the dates you worked, wages earned, paid and wages still due. You can also ask for waiting time penalties.
Sir,
From the fact pattern you have described above, it appears you may have a claim for due and owing wages as well as penalties and interest as a result. You are more then welcome to contact your local California Labor Commissioner office or even our office as we are in your area to discuss further. Best of luck.
