Worker's comp and subcontractors
Hi,

I do some independent consulting from time to time as a sole proprietorship. As such, I am not required to purchase worker's comp for myself. I recently was offered a subcontractor position with a company, but they want me to carry worker's comp on myself, since according to them, they would have to pay worker's comp for me under CA law. This does not sound correct to me, and I would like some clarification. Is there any such legal requirement? I do carry liability insurance.

It is unlawful in California to require the employee to pay any portion of workers' comp costs.

Perfectly legitimate request, that should be made of EVERY consultant by every company to protect themselves.
