An employer is free to make advances on payroll to those in 'dire need'. Properly document the terms and conditions or repayment.

It is legal but be VERY careful how you document it and have their signatures on all documentation of the advance. Also, be wary of employees who cannot wait for their paychecks. They are rarely the most reliable or trustworthy employees.
