Legal Question in Employment Law in California
Wrongful Termination
I am a real estate agent and use to work on commission only until about a year ago. The broker at my office offered me a salary and I have been working for him now. For a few months there had been rumors that I was sleeping with him, and the rumors reached his wife. She and I discussed the situation and it appeared we had resolved everything. However she had not resolved it within herself and her insecurities continued. On several occasions she questioned my actions on a personal level. So today, I dont know exactly what triggered it, but she fired me. I am not on payroll but the broker does pay me a salary through the company. So now I have no income because she believes I am sleeping with her husband. I dont know exactly what position she holds within the company or if she is part owner. I would like to know what are the chances of me having a strong case against her or the company? Her own husband, the broker, suggested I sue her as well. I just dont know if its worth it. Thank you for your time.

Re: Wrongful Termination
Your case will depend on a variety of factors. For example, does your boss's wife own any part of the company? What is her position there? More facts are needed to give you a reasonable assessment. We handle these types of cases. Feel free to contact us for a free consultation if you are serious about obtaining representation.
Re: Wrongful Termination
Your chances? None. Not unless you can somehow prove the firing was 'illegal', which you have not made out in your facts. What you described is 'politics and personality' grounds for the firing. It happens numerous times every day. Nobody said life was fair or that you had job 'security'. You are an 'at will' employee that can be fired any time for any reason, just like most employees. If you had a written contract or were in a union, then the contract terms would define your rights.
