Legal Question in Landlord & Tenant Law in California

30 Day Notice/Moving Out-Tenant

In October of 2005 I informed one of my roommates that I would be moving out, since she was my friend I told her I would pay my portion of the rent up until Dec. 1st, 2005 even though I moved out in late October 2005. She, my roommate, took it upon herself before me and let our landlord know what was going on, the landlord was always in the know. On Nov. 13th,05 I sent a 30 day notice certified to my landlord which was signed for on

Nov. 18th,05 for the month of Dec. I dropped my check, dated the 1st of Dec. 05 at my landlords house and almost a week following that I got a phone call while I was out of town that my check had bounced. As soon as I got back i took the rent money in cash to my landlord-Dec. 16th,05. In Nov. 05 the roommate called and asked me if I would help her with Jan. 06 rent, I said I don't think I will be able to-this topic was never to be discussed again. On Jan. 3rd,06 I got a phone message from the roommate threatening me that the landlord was going to take me to court. I then called the landlord and she told me, because my check bounced that means my 30 days notice is no good-and that I have to pay for Jan. 06. Consumer Affairs Dept. of L.A. says different. Please help!!!!!!!!!!

Re: 30 Day Notice/Moving Out-Tenant

payment of rent has nothing to do with whether your notice was valid. However, if the landlord sues for a period of rent due that you were still on the lease, you could be held liable for that rent up to the date of your vacancy (per your notice)
