Legal Question in Landlord & Tenant Law in California

Breaking my 2yr Lease

I now have been living w/my roommate for 3yrs. I signed a 2yr lease agreement. My bofriend want's me to move in with him and break my lease at least 8mos early. My roommates are a married couple. It is her house and recently she has been going through mood changes and has made it difficult to live with her. She and her husband have not been getting along, she is very vindictive in many ways. If you things do not go her way, she finds ways to make your life hell. How do I approach her to let me out of my lease?

Please help. She says at times she she loves me like one of her own kids and I'm part of the family but her personality ego says otherwise

Re: Breaking my 2yr Lease

I assume that the two year lease is up in 8 months. Even though you breach the contract, she is obligated to find someone as soon as possible to take over renting, at which point your obligation as to rent ends. That might be difficult to do under the circumstances. But I also suspect that the house may not be zoned for commerical purposes so any rental agreement is void. Check to find out about that and then you can use it as an excuse saying your boyfriend did not want you to be in such a position. If there is rent control in your city you might be able to use that. Otherwise, tell her flat out what the problem is, she will likely blow up and order you to leave and then she is the one is breached the contract.

Re: Breaking my 2yr Lease

If you have ben living with her for 3 years but only signed a 2 year lease, then it sounds like you are now on a month-to-month rental agreement (onless the original lease automatically renews). Giving her a 30 day notice should suffice.
