Dear Law Guru.....
Can a landlord have his agent show a condo that is occupied with a one year lease starting end of December 2009 because he wants to put it on the market for sale or should he wait until the end of the lease?

You have a lease correct? Not month to month rental? In nearly every lease there is a clause allowing the landlord to advertise and show the premises while you occupy it. Occupancy is not the same as ownership - if the property were to sell the lease would have to be assumed by the new owners on the same terms you signed. The owner has to give you reasonable notice of when the house will be shown usually 24 - 72 hours depending on your lease terms. Check your lease - that is the first place to look for rules you agreed to. The lease most likely will have a provision for placing a lock box on the door for realtors to show home also with same notice requirements. If it becomes overwhelming you need to talk to an attorney about limitations that you may be able to imposeif not signed up for in the lease agreement.
