Legal Question in Landlord & Tenant Law in California

Early Termination of Lease

I moved into a rental property sight unseen, because I was moving from out of state in a short period of time. My landlord, over the telephone, assured me that the property was decent, and explained to me that several additions were to be made, including a deck, an outdoor common area that would include a hot tub, and a small but habitable back yard. I have now been here for three months and have seen no such improvements. In addition, the exterior of the house is sub-par, and could be considered unsafe. Is there any way for me to terminate my lease without incurring penalties, and recover my security deposit?

Re: Early Termination of Lease

You might be able to void the lease for fraud in the inducement. Check with a local real estate lawyer. You will have to be prepared to assert that right in the context of defending an unpaid rent claim in court.
