Legal Question in Landlord & Tenant Law in California
Evict an adult child?
We've had enough. Our 18 year old son (soon to be 19) has pushed us to the edge so yesterday mom told him to leave and find another place to live. I packed all of his belongings and placed them outside, next to the house. Around midnight, he's ringing the doorbell and won't leave. I call the Sheriff and the deputy tells me that due to California tenancy laws I may have to evict him to get him out? What the...? He left voluntarily shortly after turning 18 and was out for about two weeks. He pays no rent or other house expenses. Doesn't that make him a ''guest'' and not a ''tenant''?

Re: Evict an adult child?
You may have to evict. Payment of rent does not impact the issue of whether or not someone is a tenant. Evictions are much faster proceedings than typical lawsuits for eliminating people from your property. Please give me a call if you would like further assistance. I would be happy to help.
