Legal Question in Landlord & Tenant Law in California

Eviction

My Grandmother has a living trust that leaves my father her home, ect. She is 96 years old and my niece and my niece's 10yr old live with her. To make a long story short my niece is a loser who verbally abuses my grandmother but my grandmother won't kick her out because she doesn't want the 10 yr old to go to foster care. My question is when my grandmother passes away how hard will it be for my dad to get her out. She has been living there for 13 years. My dad wants to sell the house but is not sure if he can just kick her out (which he has no problem doing.) Thank you .--name removed--Austin

Re: Eviction

If the niece is not on title to the real property and will not receive any interest in that property upon the grandmother's passing, then a simple eviction process will be enough to remove the niece and her daughter. Good luck.
